These Terms of Service ("Terms") govern your use of ayoniqe.com (the "Site") and your interactions with Ayoniqe LLC ("Ayoniqe," "we," "us"). By using the Site or communicating with us, you agree to these Terms.

Use of the Site

You may use the Site for lawful purposes only. You agree not to interfere with the Site's operation, attempt unauthorized access to any systems, or use automated tools to scrape or overload the Site.

Services

Ayoniqe provides communication automation and related technology services to businesses. Specific services, deliverables, fees, and terms for any client engagement are set out in a separate written agreement between Ayoniqe and the client. In the event of a conflict between these Terms and a signed client agreement, the client agreement controls.

Communications

By providing your contact information or contacting us, you agree that we may respond by phone, email, or text message, including through automated systems. Text messaging is governed by our SMS Terms, and our handling of your information is described in our Privacy Policy.

SMS messaging terms

These terms apply to text messages sent by Ayoniqe LLC. They supplement our SMS Terms & Consent page and our Privacy Policy.

• Program description. Ayoniqe LLC sends non-marketing, customer-care text messages: automatic replies to calls we were unable to answer (missed-call text-back), replies to inquiries you send us, appointment scheduling and reminders, and follow-ups on a service you requested.
• Consent. You receive messages only after you consent, by checking the optional consent box on our website form, by calling a business number operated by Ayoniqe LLC that goes unanswered, or by texting us first. Consent is not a condition of purchasing any goods or services.
• Opt out. Text STOP to any message from us at any time to opt out. You will receive one confirmation message and no further messages. Text START to opt back in.
• Support. Text HELP to any message for assistance, call us at +1 (248) 712-1807, or email ayoniqe@gmail.com.
• Message frequency and rates. Message frequency varies based on your interaction with us. Message and data rates may apply, according to your mobile plan.
• Carriers. Wireless carriers and their affiliates are not liable for delayed or undelivered messages.
• Eligibility. You must be at least 18 years old to opt in to our text messages.
• Privacy. Your phone number and opt-in consent are used only to operate this messaging program and are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Intellectual property

The Site and its content, including text, design, graphics, and logos, are the property of Ayoniqe LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce or use them without our prior written permission, except as permitted for personal, non-commercial viewing of the Site.

Disclaimers

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Information on the Site is for general purposes and does not constitute a binding offer; service availability, features, and pricing are confirmed only in a written client agreement.

Limitation of liability

To the maximum extent permitted by law, Ayoniqe LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. Our total liability arising out of use of the Site will not exceed one hundred U.S. dollars ($100). Liability in connection with client services is governed by the applicable client agreement.

Indemnification

You agree to indemnify and hold Ayoniqe LLC harmless from claims arising out of your misuse of the Site or violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute arising under these Terms will be brought in the state or federal courts located in Oakland County, Michigan.

Changes

We may update these Terms from time to time. The date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
